Agreement to Terms

These Terms of Use ("Terms") constitute a legally binding agreement between you and Paul Wakim ("we," "our," or "us") concerning your access to and use of the DAM mobile application ("App").

By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

Description of Service

DAM is a nutrition tracking application that helps users manage their calorie and macro intake using a weekly budget system. The App provides:

  • Weekly calorie budget tracking and management
  • Meal logging (manual entry, AI-assisted, and food library selection)
  • Step tracking and step credit calculations
  • Flex day scheduling for planned and unplanned events
  • Weight tracking and trend analysis
  • Win/loss gamification based on weekly performance

Eligibility

You must be at least 13 years old to use the App. By using the App, you represent that you are at least 13 years of age. If you are under 18, you represent that you have your parent or guardian's permission to use the App.

Account Registration

To use the App, you must create an account using either Google Sign-In or Apple Sign-In. You agree to provide accurate and complete information, maintain the security of your account credentials, and accept responsibility for all activities under your account.

Subscription Terms

Subscription Plans

DAM offers a Premium subscription with full access to all features:

  • Yearly Subscription: $59.99 USD per year (approximately $4.99 per month) with a 3-day free trial
  • Monthly Subscription: $9.99 USD per month (no free trial)

Free Trial

The yearly subscription includes a 3-day free trial. During the trial, you have full access to all features. If you do not cancel before the trial ends, you will be automatically charged the full yearly price. Free trials are available only once per Apple ID.

Auto-Renewal

Your subscription will automatically renew unless you cancel it at least 24 hours before the end of the current billing period. Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period.

Managing Your Subscription

You can manage your subscription and turn off auto-renewal at any time through your Apple ID Account Settings:

  1. Open the Settings app on your device
  2. Tap your name at the top
  3. Tap "Subscriptions"
  4. Select "DAM" to manage or cancel

Cancellation

You may cancel your subscription at any time through your Apple ID Account Settings. Cancellation takes effect at the end of the current billing period. You will retain access to Premium features until the end of your paid period. No partial refunds are provided for unused portions.

Refunds

Refunds are handled by Apple in accordance with Apple's refund policies. To request a refund, visit reportaproblem.apple.com.

DAM is a nutrition tracking tool intended for informational and educational purposes only. The App is NOT a medical device, and the information provided should NOT be considered medical advice.

The calorie estimates, macro calculations, and nutritional information provided by DAM (including AI-generated estimates) are approximations and may not be accurate for your specific situation.

By using the App, you acknowledge and agree that:

  • You should consult with a qualified healthcare provider before making any changes to your diet or health regimen
  • The App is not intended to diagnose, treat, cure, or prevent any disease
  • Results may vary and are not guaranteed
  • You are solely responsible for your dietary and health decisions
  • We are not liable for any health issues arising from use of the App

If you have any medical conditions, eating disorders, or health concerns, please consult with a healthcare professional before using this App.

AI-Powered Features

The App includes AI-powered meal logging that uses third-party artificial intelligence services (OpenAI) to analyze meal descriptions and estimate nutritional content.

By using the AI meal logging feature, you acknowledge that:

  • AI-generated nutritional estimates are approximations and may not be completely accurate
  • Your meal descriptions are sent to OpenAI for processing
  • You will be asked to provide consent before using AI features for the first time
  • You may decline to use AI features and use manual entry instead

Intellectual Property

The App, including its design, features, functionality, content, and trademarks, is owned by Paul Wakim and is protected by copyright, trademark, and other intellectual property laws.

You retain ownership of the data and content you create within the App. By using the App, you grant us a limited license to store, process, and display your content as necessary to provide the Service.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • The App is provided "as is" without warranties of any kind
  • We do not warrant that the App will be uninterrupted or error-free
  • We are not liable for any indirect, incidental, or consequential damages
  • Our total liability shall not exceed the amount you paid in the twelve months preceding the claim
  • We are not liable for any health issues arising from use of the App

Account Termination

You may terminate your account at any time by canceling your subscription and deleting your account through the App settings. Upon account deletion, all your personal data will be permanently deleted.

We reserve the right to suspend or terminate your account if we believe you have violated these Terms.

Changes to Terms

We may modify these Terms at any time. We will notify you of material changes through the App. Your continued use after changes become effective constitutes acceptance of the revised Terms.

Governing Law

These Terms shall be governed by the laws of the State of California, United States.
